Sweepstakes Terms and Conditions

The General Terms and Conditions and Rules for participation in prize draws apply to all prize draws published on Facebook, Instagram or any other social network of Matjaž Dobravc s.p..

Article 1 – Organisation

The organiser of the prize draw is Matjaž Dobravc s.p., V boršt 7, 1235 Preserje pri Radomljah (henceforth referred to as the Organiser).

If the prize draw is co-organised by any other company or business partner of the Promoter, the company or business partner will provide the prizes and will conduct the prize draw as agreed, and the Promoter will be responsible for the promotion of the prize draw on its website or social media channels.

If the co-organiser is responsible for providing the prizes but suddenly withdraws from the prize draw, the organiser will assume all activities and responsibilities towards the winners.

2. Article 4 – Conditions of participation

Persons with permanent or temporary residence in the Republic of Slovenia are eligible to participate in the prize draws. If a minor (under 18 years of age) is participating in the prize draw, the prior written consent of their parents or legal guardians is required in order to claim the prize.

If the prize draw is conducted on a social network, all registered users of the social network on which the prize draw is conducted who comply with the above point may enter the prize draw, unless otherwise stated in the prize draw description.

Participation in the prize draw is free of charge and is not conditional on the purchase of products from the www.refurb.si online shop.

If, as a result of participating in the prize draw, the participant incurs unforeseen costs which are not the direct fault of the prize draw organiser, the prize draw organiser shall not be liable for such costs.

Costs include:

• cost of internet access
• the cost of creating a social media account
• Internet data charges
• Cost of data theft
• Cost of data loss
• Any costs associated with the prize not directly stated in the rules of the prize draw

Employees and external contractors of Matjaž Dobravc s.p. or their immediate family members are not eligible to participate in the prize draw. Each individual may enter only once per prize draw.

The Promoter has the right to refuse participation in the prize draw or. deny the right to a prize to persons who have shown signs of blatant fraud during the voting phase, or. fraud has been reported by other users and there are reasonable grounds to suspect it. Persons who do not accept the rules of the prize draw are not eligible to enter the prize draw. By liking or commenting on a post, the entrant is deemed to have accepted the rules of the Sweepstakes.

3. Article 4 – Prizes

The Promoter will draw a winner on the specified date after the close of the competition to receive the prize as stated in the competition. The winner will be identified in a comment below the post on the page where the prize draw was held when the prize draw results are announced, unless otherwise stated in the contact method.

The draw will be conducted by a jury approved by the Organiser. A record of the draw shall be kept. The selection of the winners is final and cannot be appealed. By entering the prize draw, all entrants expressly and irrevocably agree to the publication of their profile name on the Organiser’s timeline.

No cash payment of the value of the prize is possible, prizes are non-transferable, but may be exchanged for another prize of equivalent or higher value, subject to prior agreement or non-deliverability.

4. Article 4 – Acceptance of Prizes

The winner will be informed of the prize and the conditions for claiming the practical prizes on the social network on which the prize draw was held on the day of the draw. All winners must respond within 2 working days and provide the organiser with their personal details (first name, last name, address, e-mail) to arrange collection of their prize. The prizes will be announced together with the list of winners.

The prize can be collected as agreed with the Promoter, but the most common methods are delivery by post or personal collection at the Promoter’s premises.

Article 5 – Protection of private data

By participating in the prize draw, the prize draw participants give their consent to the organiser to collect, process and store the personal data provided in accordance with the Personal Data Protection Act (ZVOP-1). The Organiser will keep the personal data of the participants provided in the context of a specific prize draw for 2 years after the end of the prize draw.

The prize draw organiser has the right to publish the personal data of the prize draw winners for the purpose of publicising the prize draw winners. The personal data collected is used for the purpose of keeping the records of the prize draw organiser.

The prize draw organiser protects all personal data in accordance with the regulations governing the protection of personal data. It may use personal data solely for the purposes for which it was obtained.

The Participant may withdraw his/her consent to the processing of personal data at any time by e-mail to: info@refurb.si or in writing to Matjaž Dobravc s.p., V boršt 7, 1235 Preserje pri Radomljah.

The controller of the personal data file must delete the personal data within 15 days of receiving the request.

Article 6 – Responsibility of the Organiser

The Organiser accepts no responsibility for:

• (non)functioning of the Facebook page,
• the (in)truthfulness of the information provided by the participants,
• (in)operation of the online service as a result of a failure of the network of the contractual partners, a power failure or other technical interruptions that could temporarily interfere with the use of the service,
• any consequences that the entrant may suffer as a result of participating in the prize draw,
• the damage that would result from the prizes,
• any consequences that any misuse of the prize draw and the prize draw system may cause to the prize draw participants and/or any third party,
• the Organiser does not cover the cost of internet communication or any other costs incurred by the participant in the prize draw.

The Promoter reserves the right to suspend or terminate the prize draw at any time and without prior notice in the event of unforeseen circumstances. The Organiser reserves the right to change the rules in order to avoid abuse of the prize draw to the detriment of entrants.

Article 7 – Complaints handling

All complaints and claims will be resolved by the prize draw organiser. In the event of justified complaints, the Organiser undertakes to remedy them as soon as possible and to inform the Participant accordingly. The Committee shall have the right to disqualify from the Competition any entrant whom it considers to have acted in breach of these Rules. The decisions of the Jury with regard to any disqualification of entrants are final.

Article 8 – Sweepstakes Instructions

The instructions for the prize draw are available on the website www.refurb.si under the “Information” tab and are accessible and available for all participants.

Article 9 – Final provision

The Organiser reserves the right to make changes to the Rules if technical, commercial or public reasons so require. The Promoter will keep participants informed of any changes and updates to the prize draw by posting on the social media page where the prize draw is being or has been held.

The rules of the prize draw will come into force on 3.1.2022.
